Middletown holds about 67,000 people spread over nearly 41 square miles of land between Sandy Hook Bay and the Navesink River. It is a place where owners stay: the Census Bureau counts close to nine in ten homes as owner-occupied, and more than 94% of residents lived in the same house a year earlier. A township median means little for a single house. A bayside cape in Port Monmouth, a split-level in New Monmouth and an older farmhouse near Middletown Village each carry their own repairs, permit history and flood questions, and we price the one in front of us.

The Township Certificate of Occupancy

Middletown requires a residential Certificate of Occupancy before title to a house changes or anyone new moves in, and the township's application says plainly that the certificate should be issued before the transfer. The request goes to Building & Inspection at Town Hall, 1 Kings Highway (732-615-2106). The current form lists a $150 CO fee and a $15 filing fee, paid as two separate checks, plus $75 if a third inspection is needed. If the house is occupied, an adult must be home for the visit, and the visit is booked around the inspector's workload rather than at a time you pick.

The checklist is built on the property maintenance code, and it catches things owners rarely think about: address numbers at least four inches tall and visible from the road, no double-cylinder deadbolts, a water heater relief pipe that ends within six inches of the floor, a solid-core door between the garage and the house, GFCI outlets along every kitchen counter, and a roof without obvious leaks. Any construction permit left open on the property must get its final inspection first. A finished basement or deck built years ago without a permit can hold up a sale here more than anything else.

There is a way through when the repairs are bigger than you want to take on. The township offers a sixty-day conditional CO: the buyer signs a notarized form agreeing to close out open permits, correct the listed violations and stay out of the house until the township approves occupancy. That is the form we sign. You sell without fixing anything, and the punch list, the permit work and the reinspections become our job after closing.

Smoke and CO Alarms Through Fire Prevention

The state's smoke and carbon monoxide certificate, which a one- or two-family sale cannot skip, is part of the Middletown CO, but a different office issues it. The Bureau of Fire Prevention (732-615-2270) takes the application after the CO inspection has been scheduled, and its fee depends on timing: $100 if the application arrives more than ten business days before closing, $125 at four to ten business days, and $150 inside four. Its inspector comes on a weekday between 8:30 a.m. and 2:30 p.m., separately from the building inspector, without a call ahead. The bureau's checklist calls for ten-year sealed or hardwired smoke alarms, one per bedroom plus one per level, and a CO alarm on each level within ten feet of the bedrooms.

On a conditional CO sale the alarm certificate is not needed until the house is ready to be lived in, so it lands on us as the buyer rather than on you.

Taxes, TOMSA and the December Tax Sale

Middletown's four quarterly tax installments land on the firsts of February, May, August and November, and the grace period normally runs ten days, closing at 3:45 p.m. at the collector's window. The state does not accept postmarks, so a check mailed on the 10th is late. On the state's 2025 table the township's general rate was 1.614 per $100 of assessed value and the effective rate, which measures tax against market value, was 1.735. Bills are mailed once a year, and the township asks sellers to pass the bill to the new owner at closing.

Sewer is a separate bill. The Township of Middletown Sewerage Authority, known as TOMSA, bills quarterly from its office at 100 Beverly Way in Belford (732-495-1010). Unpaid sewer charges follow the same path as unpaid taxes: both are listed for the township's accelerated electronic tax sale, set for December 17, 2026. After November 10, 2026 the township and TOMSA take only guaranteed funds such as a cashier's or title company check, and each delinquent account picks up a 2% cost of sale (at least $15, at most $100) plus $25 for each of two notice mailings. If a closing is near that date, the title company can pay the arrears from the price before the lien is ever sold. Bayshore Flooding and the Port Monmouth Project

North of Route 36, Middletown's bayshore neighborhoods sit low. The township keeps a published list of flood-prone streets on the bay side of the highway in Port Monmouth, Belford and Leonardo, and the U.S. Army Corps of Engineers has been building the Port Monmouth flood control project with the state and the township in five contracts. The Pews Creek floodgate and pumping station and the Port Monmouth Road floodwall are finished; the levee and floodwall sections along Route 36 and Creek Road and along Main Street were still listed as ongoing.

For a seller the bigger issue is often the substantial damage rule. When repairs or improvements to a house in the regulated flood zone cost half or more of the building's market value, the township's floodplain manager requires the whole structure to meet current flood rules, with the lowest floor raised to the FEMA base flood elevation plus one foot. A buyer with a mortgage and a renovation budget can walk away once that math is done. Historic Districts, Rentals and Vacant Homes

Middletown has five designated historic districts: Chapel Hill, Locust, Monmouth Hills, Navesink and Middletown Village, the last with ninety-nine properties along Kings Highway and nearby roads. If your house is in one, tell us early so that any exterior plans are made with the district in mind.

If the house is rented, the township charges the same CO fee for each rental unit as for a sale, and landlords file a registration statement with the Township Clerk (732-615-2015) under the state landlord identity law. Tenants keep their leases when we buy. An empty house is covered by Ordinance 2023-3333: owners of vacant and abandoned property must register, pay a $500 fee and file a certificate of insurance showing at least $1,000,000 of liability coverage by January 1 each year, with a $500 fine for missing it.
