A Borough Where People Stay

Bergenfield was incorporated on June 25, 1894. Before that the area went by Schraalenburgh, and the modern name traces back to 1873, when a railroad could not get residents to agree on a station name and simply printed "Bergen Fields" on its tickets. Today the borough holds close to 29,000 people on under three square miles. Seven in ten homes are owner-occupied, households average just over three people, and almost nobody moves in a given year: the Census Bureau found nearly 96% of residents living in the same house as twelve months before.

Long ownership has a side effect. A house bought decades ago may have a finished basement, a converted garage or a second kitchen that never got a permit, and an owner who has never had to think about it until the sale. Those are exactly the items Bergenfield's resale inspection looks for, so it helps to know the rules before choosing how to sell.

The Resale Certificate and Its Checklist

Bergenfield's construction code office issues a Certificate of Resale or Rental for one-family, two-family and multi-family homes. The borough asks for the application at least two weeks before closing. Fees combine a construction charge with a $45 fire fee:

The application packet goes further than most. Both the owner and the buyer sign sworn, notarized statements about whether the house is used as a one-family or a two-family. The buyer also signs an agreement that the basement or attic will not be used as a separate apartment, with no bedrooms and no cooking there. The borough's checklist then covers the house itself, including:

  • sound walkways and stairs, with handrails on every exterior stair, and roofs, gutters and leaders in good shape;
  • a house number posted at or near the door, exterior paint in fair condition, broken glass replaced;
  • no leaking supply or waste lines, and a sump pump that drains outside rather than into the sewer;
  • properly sealed flues on vented heating equipment and water heaters, with the relief-valve pipe ending within six inches of the floor;
  • deadbolts on exterior doors that open with a thumb latch from inside, not a key;
  • any basement kitchen installed without a permit taken out;
  • the yard cleared of garbage, overgrowth and unregistered vehicles.

Two items surprise people. The borough will not issue the certificate unless its own trash and recycling bins are at the house, and a seller missing them pays to replace them, at $55 each. And any open permit holds up the process until it is closed.

Smoke and Carbon Monoxide Form

Bergenfield folds the state alarm requirement into the same packet, on a sworn form the seller signs before a notary. The boxes to check: ten-year sealed smoke detectors on every level of the house, basement included (attic and crawl space excepted), smoke and carbon monoxide detectors outside each sleeping area within ten feet of the bedrooms, and every detector working. In homes built before January 1977 that already have AC-powered or interconnected detectors, those have to be kept working.

Two-Family Homes and Rental Registration

Since 2003 Bergenfield has required yearly registration and inspection of every two-family house, even one where the owner lives in half of it, and every single-family house the owner does not live in. Registrations are due between January 1 and February 15, at $50 per rental unit, waived for qualifying seniors and veterans. Units are inspected each year and again whenever the occupancy changes, and the borough does not allow rooms to be rented out individually. The borough also has a Rent Leveling Board, which meets on the first Wednesday of the month; if you rent out apartments, ask the board whether any rent limits apply to them before you sell.

Taxes, Tax Searches and Added Assessments

The tax office is on the second floor of Borough Hall, 198 North Washington Avenue, Room 215. Quarterly payments are due August 1, November 1, February 1 and May 1, and to avoid interest the money has to be in the office by the 10th, or the next business day if the 10th falls on a weekend or holiday. A postmark does not count. Interest is 8% a year on the first $1,500 and 18% beyond that, figured back to the 1st. A drop slot on the outside of the building, at the south end, takes payments any time; anything in by 4:30 p.m. on a weekday posts that day.

On the state's 2025 figures, Bergenfield's general tax rate was 3.738 and its effective rate 2.202 per $100 of value. Before any sale, the borough suggests a municipal tax search from the collector, $10 and two to four business days, which shows unpaid taxes, open building or plumbing permits, and any added or omitted assessment still to come. That last item matters: improvements such as a finished basement or a new deck can trigger an added assessment bill in October, and a buyer's attorney will want it settled at closing. The borough's tax page says unpaid municipal liens are subject to sale on the 11th day of the 11th month, and it runs that sale online. Sewer Laterals, Water and Flood Rules

Bergenfield maintains the sewer mains, but the borough is clear that the owner is responsible for the entire lateral, from the house all the way to the main. A backup caused by roots in that line is the owner's repair, which is worth knowing if a camera inspection has ever shown trouble. Water comes from Veolia's Hackensack system, which state records list as serving Bergenfield; ask Veolia for a final reading before settlement. The borough also has a floodplain ordinance on its books (No. 25-2648), and every New Jersey seller now fills in the state's flood risk disclosure, so mention any water in the basement or past insurance claims honestly. None of it stops us from buying.
