Who Lives in Berkeley Township
Berkeley Township, with its municipal offices in Bayville, has about 45,500 residents across almost 43 square miles. Its age profile stands out even in Ocean County: 42.6% of residents are 65 or older, compared with 24% countywide, and households average just two people. Close to 89% of homes are owner-occupied, and the median owner-occupied value of $310,000 sits well below the county's.

With an older population, a Berkeley sale may be run by an adult child, an executor, or an owner moving to be near family or into care. In that position, skipping repairs and showings and handing off the township paperwork can matter more than anything else. That is the job we take on.
The Resale Certificate of Occupancy
Berkeley requires a certificate of occupancy every time a home is sold, and for rentals every time the tenant changes. Since April 8, 2024, the resale CO with its smoke and carbon monoxide certificate costs $150, and a transfer of title without a resale costs $100. Code Enforcement at Town Hall handles it (732-244-7400, ext. 1506), and the Bureau of Fire Prevention signs off on the alarms.
This is a fuller inspection than a simple alarm check. The township's written requirements for a resale include:
- Working smoke and carbon monoxide alarms within ten feet of the sleeping areas.
- Handrails on any run of three or more steps, a solid-core or sheathed door between the garage and the house, and a deadbolt on the entry that opens without a key from inside.
- Heat, hot and cold water and plumbing in working order, a dry foundation, and window screens in place between May 1 and October 1.
- Outside: roof, gutters, decks, fences, sheds and any bulkhead in good repair, and street numbers visible from the road.
- A well certification from the county health department if a well supplies the house, and a leak test and certification if it is heated with oil.
- For a property in a flood zone, a current flood elevation certificate with a raised seal.
- Every open permit closed before the CO is issued, and someone on site to run the utilities. A termite report may also be required.

Age-Restricted Communities: The Association Letter
Berkeley adds a step for homes in its age-restricted communities. The township will not process a resale, a rental or any transfer of title there without an original approval letter from the homeowners association, signed in ink; copies and duplicates are refused. Because nothing moves without it, the letter is worth requesting on day one.
We ask the association for the letter as soon as you sign, give it whatever buyer information it requests, and keep the township's CO moving at the same time. If the home belonged to a parent, the executor can authorize all of this once the Surrogate issues letters.
Taxes, a 2027 Revaluation and South Seaside Park
Berkeley mails tax bills once a year in July; the first two quarters are estimates and the last two settle the year. Installments fall on the first day of February and May and again of August and November, and each carries ten days of grace. Late amounts draw 8% on the first $1,500 and 18% beyond that, and a delinquency over $10,000 adds a 6% penalty. On the state's 2025 figures, Berkeley's general rate was 2.590 per $100 and its effective rate 1.498.
Change is coming on two fronts. The Ocean County Board of Taxation has ordered a township-wide revaluation for the 2027 tax year, the first in almost fifteen years, because assessments no longer track market value. And owners in South Seaside Park, on the barrier island, are told to keep paying taxes to Berkeley through the end of 2026, with any change in collection taking effect January 1, 2027. If you are selling across either change, the title company prorates the tax for the days you owned the house.
Unpaid taxes still open at year-end go to the tax sale, and the township says it assigns its own liens to the township attorney each year for in rem foreclosure, which can end in the township taking title. Flood Rules on the Bay Side
Berkeley reaches the barrier island at South Seaside Park, its floodplain forms include a V-zone design certificate for coastal construction, and the township is applying the state's REAL rules, adopted January 20, 2026. Its July 2026 notice explains that the state mapped a new Inundation Risk Zone and set a Climate Adjusted Flood Elevation four feet above the base flood elevation, with the township's own freeboard added on top to reach the design elevation for new construction and renovations. A grace period for some state permits runs to July 20, 2027, but local flood applications already follow the new standard. The township's flood mitigation officer can be reached at 732-575-3232.
For a seller, this means a low house in the zone may be costly for the next owner to improve, and the resale CO still asks for the elevation certificate. The state flood risk disclosure applies too. We buy those homes for cash and take on the elevation question ourselves.
Rentals and Foreclosure Registration
Berkeley landlords file a registration every year with an unexpired certificate of liability insurance of at least $500,000 and a $25 fee, and each new tenant triggers a new rental CO. Rentals built before 1978, apart from multi-unit buildings and seasonal rentals, also need a lead-based paint inspection, handled for the township by an outside contractor. When a lender files a foreclosure, it must register the property with the township within ten days for $500 a year, and an empty house adds $2,000. The township keeps the property on that list until a transfer of title or certificate of compliance is filed.
